A Life-Changing Accident and Years of Treatment

The plaintiff was rear-ended by a fuel tanker truck at a stop light in El Paso. At the time of the crash, the plaintiff was 70 years old and had several preexisting health problems but never any prior pain in her neck and back. That all changed after the crash.

A couple of days after the accident, the plaintiff had an MRI. The test showed several disc herniations and annular tears, but also showed degenerative changes to her spine.

The plaintiff underwent conservative treatment for three years. However, they had a gap in treatment for over a year that started about six weeks after the crash. Eventually, they received a recommendation to have surgery.

Bringing the Battle to the Courtroom

The defense attempted to settle for significantly less. When their last formal offer was less than 100k, our experienced truck accident lawyers took the fight to El Paso County Court at Law No. 6 to ensure our client received the compensation they deserved. The trucking company’s legal team argued that their injuries should be undervalued due to their age—nearly 70 years old at the time of the crash. The defense also refused to acknowledge any significant injuries to the client’s spine other than sprains and strains they say lasted only six weeks before the gap in treatment.

The El Paso jury agreed. They weren’t buying what the defense was trying to sell and awarded our client $4,715,000.
