How Do I Prove My Car Accident Claim?

Car accident claims are based on the doctrine of negligence. Negligence refers to careless actions or the failure to act when one should have. You need to prove four elements to be successful:

  1. Duty of care. To be liable, the party being sued must have owed you a duty of care. All drivers have a duty to drive safely and obey traffic laws.
  2. Breach of duty. Next, you must show the party breached their duty. Examples of a breach include driving while intoxicated, running a red light, or speeding.
  3. Causation. You must prove that the party’s breach caused your injuries.
  4. Damages. You must prove you suffered damages as a result of the car accident.

Your seasoned car accident attorney can help you calculate your damages to determine your financial loss.

How Long Do I Have to File a Car Accident Claim?

The deadline to bring a car accident claim is three years. The clock starts to tick on the date of the accident. If you fail to bring a claim before the deadline expires, you are generally barred from recovery.
