Bernalillo County, NM (April 11, 2023) — The New Mexico State Police are currently investigating a crash in Bernalillo County that left one person dead and one injured on Sunday afternoon. The accident occurred at around 12:10 PM on I-40 near mile marker 153, just outside Albuquerque.

According to authorities, a 2021 Freightliner CMV was driving eastbound on I-40 with two occupants. For reasons that are still unknown, the driver left the interstate, causing the semi-truck to roll. Both the passenger and the driver were ejected during the crash. The passenger, identified as 39-year-old Eric Remaly of San Bernardino, CA, was pronounced dead on the scene. The driver, an unnamed 42-year-old female, was sent to an area hospital and is being treated for non-life-threatening injuries.

So far, alcohol does not seem to be a factor in the accident. However, it appears that neither the driver nor the passenger were wearing seatbelts at the time of the crash.

Our Attorneys Offer Their Condolences to Those Affected by this Semi-Truck Crash

Our hearts go out to the victim as well as the friends and family members affected by this tragic accident. We hope that New Mexico State Police are able to find out the cause of the crash. If it is found that negligence played a role in this devastating incident, the responsible party should be held accountable for their actions. Unfortunately, many accidents like this are often preventable.

The Rights of Family Members of Deceased Victims

When a loved one tragically loses their life in a semi-truck accident, it’s important to know your family’s options. In many cases, surviving family members are able to file a wrongful death claim against the party responsible for their loved one’s death. This type of claim allows families to claim damages from their loss, including but not limited to:

  • Funeral and burial expenses,
  • Loss of inheritance,
  • Loss of financial support,
  • Mental anguish, and
  • Pain and suffering.

While no amount of money can replace a human life, the goal of a wrongful death suit is to provide the family of the deceased with the financial means to deal with such a tragedy. This requires looking at the deceased’s career trajectory, their contributions to the household, and the impact they had on the lives of their spouse, children, parents, etc.
