Deming, NM (July 10, 2023) — One person is dead and two others are injured after a commercial truck caused a three-vehicle accident on Sunday, July 2. The crash happened around 10:00 PM on Highway 26 near mile marker 10, north of Deming.
According to investigators, a 1993 water tanker truck was traveling east on Highway 26. At the same time, a 2016 commercial motor vehicle (CMV) was also heading east on the highway. For unknown reasons, the CMV hit the back of the water tanker truck, causing it to cross into the westbound lane and collide head-on with a 2019 Chevy SUV.
One of the passengers of the SUV, 77-year-old Kay Chandler from Deming, NM, was taken to a nearby hospital but died from her injuries. The driver of the CMV and another passenger in the Chevy SUV were also taken to a hospital. However, their current conditions are unknown. The driver of the water tanker truck was not hurt, and alcohol does not appear to be a factor in the crash.

Options for Family Members Following a Fatal Car or Truck Crash

Whether you lost a loved one in this fatal car crash in Luna County or another, you may have legal options. In New Mexico, family members of the deceased may file a wrongful death claim. This type of claim, much like other civil accident claims, seeks damages for losses. However, it specifically seeks to reimburse the family for the losses related to their loved one’s death. This includes:

  • Funeral and burial costs,
  • Loss of financial support,
  • Loss of consortium for spouses
  • Medical expenses from the cause of death,
  • Lost inheritance, and
  • Pain and suffering.

Ultimately, the cost of losing a loved one goes far beyond the financial impact. The emotional and mental devastation that their death leaves is just as destructive. While wrongful death damages cannot replace a life, they are just one of the few ways a family may seek recompense.
