Filing a Personal Injury Claim

When accidents like this occur, it’s essential to determine if negligence is involved. If negligence led to the crash, those injured may be eligible to file personal injury claims. Below are the critical elements of a personal injury case and what victims should know when pursuing compensation.

What Is Negligence?

Negligence refers to the failure to act with reasonable care, leading to harm to others. In car accident cases, negligence can take many forms. It may involve another driver acting recklessly, a municipality failing to maintain safe roads, or a vehicle manufacturer producing a defective part. If any party is found negligent, they could be held legally responsible for the resulting injuries.

Proving Negligence in a Car Accident Case

Four key elements must be established to file a personal injury claim successfully:

  1. Duty of care. The injured party must show that the at-fault party had a duty to act with reasonable care. For example, drivers must operate their vehicles responsibly, municipalities must maintain safe road conditions, and manufacturers must ensure that vehicles and their components meet safety standards.
  2. Breach of duty. It must be proven that the at-fault party breached their duty of care.
  3. Causation. The injured party must demonstrate that the breach of duty directly caused the accident and their injuries.
  4. Damages. Finally, the injured party must provide evidence of the damages they suffered from the accident. These damages include medical bills, lost wages, pain and suffering, and emotional distress.

Victims in New Mexico have the right to seek compensation for the damages they suffered and hold the negligent party accountable.
